What a notice must include

The law (17 U.S.C. 512(c)(3)) requires a written notice with all of the following. If something is missing, we will tell you what, and we may not be able to act until you send it.

  1. Your physical or electronic signature, as the copyright owner or a person authorized to act for the owner. Your typed full name works as an electronic signature.
  2. The copyrighted work you believe was infringed. If one notice covers several works, a representative list is enough.
  3. The material you want removed, with enough detail for us to find it: the link to the page, and the review or text quoted or described.
  4. Your name, mailing address, phone number and email address.
  5. A statement that you believe in good faith that the use of the material is not authorized by the copyright owner, its agent or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act for the owner.

What happens next

When a notice is complete, we remove or disable access to the material promptly and keep a record of the notice and what we did. If we have a way to reach the person who posted the material, we tell them it was removed and why.

Knowingly claiming that material infringes when it does not can make you liable for damages, including costs and attorney's fees (17 U.S.C. 512(f)). If you are not sure, consider asking a lawyer before you send a notice.

Counter-notice

If material you posted was removed because of a copyright notice and you believe that was a mistake or a misidentification, you can send a counter-notice to the same agent. Under 17 U.S.C. 512(g)(3) it must include:

  1. Your physical or electronic signature.
  2. The material that was removed, and where it appeared before it was removed.
  3. A statement, under penalty of perjury, that you believe in good faith the material was removed or disabled as a result of a mistake or misidentification.
  4. Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for the district where your address is (or, if your address is outside the United States, any judicial district in which StreetSpy may be found), and that you will accept service of process from the person who sent the original notice or their agent.

A counter-notice gives up your anonymity to the person who sent the notice. The law requires us to send them a copy, including your name and contact details.

When we receive a complete counter-notice, we send that copy and tell the sender we will put the material back. We restore it no sooner than 10 and no later than 14 business days after we received the counter-notice, unless the sender first tells us they have filed a court action to stop the alleged infringement.

Repeat infringers

We terminate the accounts of users who are the subject of repeated valid copyright notices, and we may block further contributions from them. A valid notice is a complete notice that we acted on and that was not reversed by a counter-notice.
